Dubai Chamber of Commerce and Industry, in cooperation with Al Tamimi & Co., organized a webinar offering businesses clarity and guidance on complying with existing Economic Substance Regulations in the UAE on 15th February, 2021.
A total of 390 participants joined the webinar, including business owners, managers and legal professionals. The session was led by Shiraz Khan, Partner, Head of Taxation; Noff Al-Khafaji, Senior Associate, Corporate Structuring; and Janet Gooi, Senior Associate, Tax at Al Tamimi & Company; who provided an overview of the economic substance regime, latest developments, compliance requirements and sanctions for non-compliance.
The UAE issued the Economic Substance Regulations in 2019, which was subsequently replaced by a new set of Economic Substance Regulations in 2020. Further updated guidance on the economic substance regime was issued by the Ministry of Finance to provide further clarification and help businesses comply with the regime in the UAE.Jehad Kazim, Vice President -Legal Services at Dubai Chamber, stressed on the importance of complying with existing economic substance regulations and noted that the webinar raised awareness about the matter.

UAE FTA conducts its second virtual workshop for tax agents on tax treatment of e-commerce

The Federal Tax Authority(FTA) confirmed that several general Value Added Tax (VAT) rules apply to e-commerce transactions, in addition to a number of special VAT rules specifically applied to e-commerce transactions. E-commerce refers to the supplies of goods and services on digital platforms, via computers or mobile phones purchased from websites or electronic applications.
The workshop saw the participation of 225 accredited tax agents and a number of FTA officials. The FTA gave a presentation on how to apply VAT on the supplies of goods and services made within the e-commerce framework and how to calculate VAT on these supplies. The FTA also presented an overview of e-commerce, the principles of VAT on the supply of goods via e-commerce and the supply of electronic services, and the effects of VAT on electronic markets using practical examples. The presentation indicated that all goods and services purchased through online shopping sites are generally subject to 5% VAT if the place of supply is in the UAE. The tax is also applied to most of the goods that are sold inside the UAE; subject to some exceptions per the VAT legislation (such as medicines sold on websites). Additionally, the import of goods is subject to VAT.
His Excellency Khaled Ali Al Bustani, Director General of the FTA, stressed that the number of FTA accredited tax agents is increasing steadily, in line with the continuous growth of taxable persons within the tax system. H.E. Al Bustani said: “The number of accredited tax agents increased in the first 10 months of 2020 by more than 10% to 515, compared to 468 in the same period last year. This increase provides more opportunities for taxpayers wishing to deal with the FTA through tax agents by offering them an extensive, constantly-updated list of approved agents on the FTA’s website.”

A virtual workshop was organized for 213 accredited tax agents addressing the timespan for input tax recovery and redemption procedures.
Inquiries from participants were addressed and the procedures for recovering input tax incurred for specific expenses were clarified. The expenses include COVID-19 pandemic, marketing, entertainment expenses, vehicle expenses, and events beyond taxation control.
The Authority clarified that expenses pertaining to COVID-19, such as the sterilization of the workplace and the testing of employees, are under general expenses. Input tax is recoverable in the event that the supplies and services made by the business are themselves taxable. In case the business is making taxable supplies only, the input tax is fully refundable. However, in the event that the business is making taxable and tax-exempt supplies, the input tax will be partially refundable. The FTA indicated that input tax cannot be recovered on the expenses of testing employees’ families unless the employee bears the cost.
The representatives of the FTA explained the tax procedures for deducting input tax in accordance with the reverse charge mechanism and the provisions related to the standard method for apportioning input tax. They discussed the technical aspects that could be misinterpreted and explained the legal principles, with application-based examples. Further, they presented the most common reasons for requesting further information with respect to applying to use of one of the special methods for apportioning input tax.
